In 1969 and also in 1987, the State of Maine legislature signed into law a process by which any landowner believing his or her water supply to be adversely affected by public con- struction, reconstruction, or maintenance of roads can apply to the political subdivision for redress (23 M.R.S.A. §652 (Maine Legislature, 2012, p. 60–61) and §3659 (Maine Legislature, 2012, p. 227–229)). Adverse effects can include those from road salting (University of Maine, School of Law, 2003; Maine Department of Transportation, 2004; State of Maine Judicial Branch, 2008), and redress can include replacing plumbing and (or) heating systems, replacing the water supply, repairing damage to the water supply, paying a designated sum of money, and (or) purchasing the real estate served by the water supply.
