THIS CASEBOOK contains a selection of U. S. Court of Appeals decisions that analyze and discuss issues surrounding Medicare fraud. Volume 1 of the casebook covers the DC Circuit and the First through the Fifth Circuit Court of Appeals. * * * The False Claims "Act is intended to reach all fraudulent attempts to cause the Government to pay ou[t] sums of money or to deliver property or services," and "[a] false claim for reimbursement under Medicare, Medicaid, or similar program ... may be false even though the services are provided as claimed." S. Rep. No. 99-345, at 9 (1986). Thus the Anti-Kickback Statute and False Claims Act were not drafted to cabin healthcare providers' liability for certain types of false claims or for certain types of illegal kickbacks. Instead, Congress intended both statutes to reach a broad swath of "fraud and abuse" in the federal healthcare system. H.R. Rep. No. 95-393, at 47 (1977). US ex rel. Greenfield v.
